Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the Brain Settle app and website (together, the "Service"), provided by its independent developer ("we," "us," or "our"). By downloading, accessing, or using Brain Settle, you agree to be bound by these Terms. If you don't agree, please don't use the Service.

Description of the service

Brain Settle provides guided word-focus and breathing activities intended to support general wellbeing. It is not a medical device and does not provide medical advice, diagnosis, or treatment. See our Disclaimer for more on this.

Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use Brain Settle. By using the Service, you confirm that you meet this requirement.

Subscriptions, trials, and billing

• Brain Settle may offer a free trial period (currently 30 days) followed by a paid subscription or one-time purchase, as described on the app's store listing at the time of purchase.
• All payments are processed by the Apple App Store or Google Play billing system, depending on your device. Pricing, billing cycles, and available payment methods are governed by their respective terms.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time through your Apple ID or Google Play account settings — we don't have the ability to cancel it on your behalf.
• Except where required by law or by Apple/Google's own refund policies, payments are non-refundable.

Acceptable use

You agree not to misuse the Service — including attempting to interfere with its operation, reverse-engineer the app beyond what's permitted by law, or use it for any unlawful purpose.

Intellectual property

Brain Settle's app, website, branding, word libraries, and design are owned by us or our licensors and protected by copyright and other intellectual property laws. Using the Service doesn't grant you ownership of any of this — just a personal, non-transferable license to use the app for its intended purpose.

Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We don't guarantee the Service will be uninterrupted, error-free, or that it will meet your specific needs or produce any particular outcome.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service.

Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll update the "last updated" date above, and continued use of the Service after changes take effect means you accept the revised Terms.

Governing law

These Terms are governed by the laws of Australia, without regard to its conflict of law principles. Nothing in these Terms limits any consumer guarantee or other right you have under the Australian Consumer Law that cannot lawfully be excluded.
